OVERVIEW

This website is operated by Scentia USA, LLC. Throughout the site, the terms “Scentia,” “we,” “us,” and “our” refer to Scentia USA, LLC.

Scentia offers this website, including all information, tools, products, and services available through it, conditioned upon your acceptance of these Terms of Service and all policies and notices referenced here.

By visiting our website, creating an account, or purchasing from us, you engage in our “Service” and agree to these Terms of Service. These Terms apply to all site users, including browsers, customers, vendors, merchants, and contributors of content.

Please read these Terms carefully. If you do not agree to them, you may not access the website or use our Service.

Our store is hosted by Shopify Inc., which provides the e-commerce platform through which we sell our products and services.

These Terms apply prospectively from the effective date above. A purchase is generally governed by the policies presented or made available when that order was placed, except when applicable law requires otherwise.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least 18 years old or have reached the age of majority in your jurisdiction.

You may not use our products or Service for an illegal or unauthorized purpose or violate applicable laws while using the Service.

You must not transmit viruses, malware, destructive code, or any material intended to interfere with the operation or security of the Service.

A material breach of these Terms may result in termination or restriction of access to the Service.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse or limit Service when permitted by law, including in cases involving suspected fraud, abuse, resale activity, payment risk, policy violations, or threats to our employees or systems.

Content you submit, excluding payment-card information, may be transferred across networks and modified to conform to technical requirements. Payment-card information is encrypted during network transmission.

You may not reproduce, duplicate, copy, sell, resell, or exploit any part of the Service without our written permission.

Headings are included for convenience and do not limit these Terms.

SECTION 3 — WEBSITE INFORMATION

We make reasonable efforts to keep website information accurate and current. Some material may be provided for general information or historical reference.

Product availability, packaging, design, specifications, promotions, and pricing may change. We may update website content when necessary.

Nothing in this section permits Scentia to disregard a material representation or obligation that cannot legally be excluded.

SECTION 4 — SERVICE AND PRICE CHANGES

Product prices may change without notice before an order is placed.

We may modify, suspend, or discontinue all or part of the Service, subject to obligations for orders already accepted and applicable law.

We are not liable for a website modification, price change, suspension, or discontinuation except to the extent required by law or an existing contractual obligation.

SECTION 5 — PRODUCTS, BUNDLES, QUANTITIES, AND PROMOTIONAL CONTENT

Certain products or services may be available exclusively online and in limited quantities. Returns and exchanges are governed by our Return and Refund Policy.

Product and Bundle Contents

The products and quantities included in an order are determined collectively by:

  • The product and variant selected

  • The written product title and “What’s Included” section

  • The quantity selected in the shopping cart

  • The checkout summary

  • The final order confirmation

For bundles and promotional sets, each bundle contains only the products and quantities expressly listed for that bundle.

Increasing a bundle’s cart quantity multiplies its expressly listed contents by the selected quantity. It does not add other products merely displayed in photographs, videos, demonstrations, comparison graphics, or customer content.

Photographs and Videos

We make reasonable efforts to display product colors, dimensions, packaging, and appearance accurately. Actual colors may vary because of screens, lighting, packaging updates, and manufacturing variations.

Lifestyle photographs, videos, promotional graphics, and demonstrations may show multiple products, alternate colors, fragrances, accessories, decorative objects, or suggested uses. Visually displayed items are not included unless the written listing or order summary expressly identifies them as included.

Customer Review Before Purchase

Customers are responsible for reviewing the selected variant, bundle contents, quantities, shipping address, and checkout summary before submitting an order.

If the written listing, checkout summary, and order confirmation appear inconsistent, customers should contact cs@scentiausa.com promptly.

Nothing in this section limits remedies for a material advertising or fulfillment error confirmed by Scentia or rights that cannot legally be waived.

SECTION 6 — ORDERS, BILLING, AND ACCOUNT INFORMATION

We may refuse, limit, or cancel orders when reasonably necessary, including orders associated with suspected fraud, unauthorized resale, incorrect pricing, inventory errors, payment risk, or violations of these Terms.

Restrictions may apply to orders connected by customer account, payment method, billing address, shipping address, device, or other reasonably relevant information.

If we modify or cancel an order, we may attempt to notify the customer using the contact information supplied at checkout. If we cancel a paid order before fulfillment, we will issue the appropriate refund.

Customers agree to provide accurate and current account, billing, contact, and shipping information.

The customer is responsible for reviewing the shipping address before placing the order. Address changes are not guaranteed after an order has entered processing or fulfillment.

An automated order-confirmation email acknowledges receipt of an order. We may conduct payment, inventory, address, and fraud reviews before fulfillment.

SECTION 7 — SHIPPING AND DELIVERY

Shipping estimates are estimates and are not guaranteed delivery dates unless expressly stated otherwise.

Customers are responsible for providing a complete and accurate shipping address and for maintaining a reasonably secure delivery location.

Once the carrier marks an order as delivered at the shipping address supplied during checkout—including a mailbox, parcel locker, mailroom, front desk, doorstep, or another location at or associated with that address—the order is considered delivered.

Customers who cannot locate a carrier-confirmed delivery should promptly check with household members, neighbors, property management, mailroom personnel, and the shipping carrier.

Scentia is not responsible for packages lost, stolen, misplaced, or otherwise not located after carrier-confirmed delivery, except when:

  • The carrier confirms that the package was misdelivered;

  • Scentia shipped the order to an address different from the address shown on the order; or

  • Applicable law requires another result.

Safe Ship protection claims are governed by the applicable Safe Ship terms.

SECTION 8 — RETURNS, DEFECT CLAIMS, AND WARRANTIES

Returns, exchanges, defective-product claims, warranties, restocking fees, promotional gifts, and refund eligibility are governed by our Return and Refund Policy, which is incorporated into these Terms.

A return request alone does not complete a return. Unless Scentia waives the requirement or applicable law provides otherwise:

  • The return must be authorized;

  • The customer must follow the return instructions;

  • The merchandise must be physically returned;

  • The return must be received and inspected before a refund is issued.

Customers reporting damage, missing components, an incorrect item, or a malfunction may be required to provide photographs, video, packaging evidence, troubleshooting information, and other reasonably necessary documentation.

A customer requesting a refund based on the condition, performance, contents, or acceptability of merchandise generally may not keep the merchandise and also receive a full refund.

Additional products are not owed when the products and quantities delivered match the order confirmation, unless Scentia confirms a material listing or fulfillment error or applicable law requires another remedy.

Nothing in these Terms excludes warranties, return rights, or remedies that cannot legally be waived.

SECTION 9 — PAYMENT DISPUTES AND CHARGEBACKS

Customers are encouraged to contact cs@scentiausa.com before initiating a payment dispute so we have an opportunity to investigate and resolve the concern.

Opening a chargeback does not automatically establish that a transaction was unauthorized, that merchandise was not delivered, or that merchandise was defective.

A payment dispute also does not create a separate right to retain merchandise without payment or eliminate applicable return requirements.

While a chargeback is active, Scentia may pause a separate refund relating to the same transaction to prevent duplicate reimbursement. This does not prevent an authorized return or limit rights that cannot legally be waived.

When responding to a payment dispute, Scentia may provide the payment processor, card network, issuing bank, law-enforcement authority, or other appropriate party with relevant records, including:

  • Checkout and order information

  • Product and variant selections

  • Product listings in effect when available

  • Billing and address-verification results

  • Fraud-screening results

  • Carrier tracking and delivery confirmation

  • Customer communications

  • Photographs, video, or troubleshooting records

  • Return authorizations and return tracking

  • Records showing whether merchandise was returned

  • Applicable policies and evidence of policy presentation

Scentia may contest claims that conflict with reliable order, delivery, communication, or return records.

Nothing in this section prevents a customer from lawfully disputing an unauthorized transaction, merchandise not received, or merchandise materially different from what was purchased.

SECTION 10 — OPTIONAL TOOLS

We may provide access to third-party tools that we do not monitor or control.

Access to these tools is provided “as is” and “as available” without representations, warranties, or endorsements, to the maximum extent permitted by law.

Customers should review and approve the third party’s applicable terms before using an optional tool.

Future tools and features added to the Service will also be subject to these Terms.

SECTION 11 — THIRD-PARTY LINKS

The Service may include materials or links provided by third parties.

Third-party links may direct customers to websites that are not affiliated with Scentia. We are not responsible for examining or evaluating their content, accuracy, policies, products, or practices.

Transactions conducted through third-party websites are governed by those third parties’ terms and policies. Customers should review them carefully before completing a transaction.

SECTION 12 — USER COMMENTS, FEEDBACK, AND SUBMISSIONS

If you send ideas, suggestions, proposals, feedback, reviews, photographs, or other materials, you grant Scentia permission to use, reproduce, edit, translate, publish, and distribute those materials to the extent permitted by law.

We are not obligated to maintain unsolicited submissions in confidence, compensate the sender, or respond.

We may remove content that we reasonably determine is unlawful, threatening, defamatory, obscene, infringing, fraudulent, or otherwise violates these Terms.

You are responsible for the accuracy and legality of content you submit. You may not impersonate another person, use a false identity, or submit materially false or misleading information.

SECTION 13 — PERSONAL INFORMATION

Our collection and use of personal information are governed by our Privacy Policy.

Information relevant to fraud prevention, fulfillment, returns, or payment disputes may be processed and disclosed as described in that policy and as permitted by law.

SECTION 14 — ERRORS, INACCURACIES, AND OMISSIONS

Website content may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, bundle contents, pricing, promotions, shipping charges, transit estimates, or availability.

We may correct errors and update information. If we discover a material error before fulfillment, we may contact the customer for instructions or cancel the affected order and issue the appropriate refund.

For fulfilled orders, reported discrepancies will be reviewed using the product listing, selected variant, checkout record, order confirmation, customer communications, and other relevant evidence.

A corrected listing does not retroactively change the terms governing an earlier purchase. The listing and policies applicable to a disputed transaction must be evaluated using reliable records from the relevant time when available.

Nothing in this section permits deceptive advertising or removes a remedy required by applicable law.

SECTION 15 — PROHIBITED USES

You may not use the website or Service:

  • For an unlawful purpose;

  • To violate applicable laws or the rights of another person;

  • To submit materially false, fraudulent, or misleading information;

  • To infringe intellectual-property or privacy rights;

  • To harass, threaten, abuse, defame, or discriminate against another person;

  • To upload or transmit malicious code;

  • To collect personal information unlawfully;

  • To spam, phish, scrape, or interfere with the Service;

  • To circumvent security or fraud-prevention features; or

  • To abuse promotions, returns, refunds, warranties, payment disputes, or customer-support processes.

We may restrict or terminate access to the Service for violations of this section, subject to applicable law.

SECTION 16 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that access to the Service will always be uninterrupted, timely, secure, or error-free.

Except for express warranties provided by Scentia and warranties or rights that cannot legally be excluded, the Service and products are provided “as is” and “as available.”

To the maximum extent permitted by law, Scentia and its directors, officers, employees, affiliates, agents, contractors, suppliers, and service providers will not be liable for indirect, incidental, punitive, special, or consequential damages arising from use of the Service or products.

Some jurisdictions do not permit certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

SECTION 17 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Scentia and its affiliates, officers, directors, employees, agents, contractors, licensors, service providers, suppliers, and subcontractors from third-party claims arising from your material breach of these Terms or violation of another party’s rights.

SECTION 18 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and severed to the extent necessary.

The remaining provisions will remain in effect.

SECTION 19 — TERMINATION

Obligations and liabilities incurred before termination survive termination when appropriate.

You may stop using the Service at any time.

If you materially violate these Terms, we may restrict or terminate your access to the Service. You remain responsible for amounts lawfully owed before termination.

SECTION 20 — ENTIRE AGREEMENT

These Terms and the policies incorporated by reference constitute the agreement between the customer and Scentia concerning use of the Service and purchases from the store.

Failure to enforce a provision does not waive that provision.

These Terms supersede prior communications concerning the same subject, but they do not retroactively replace the terms applicable to an order placed before the effective date.

SECTION 21 — GOVERNING LAW

These Terms and related agreements are governed by the laws of the State of Florida, United States, without eliminating consumer rights that apply under mandatory law.

SECTION 22 — CHANGES TO THESE TERMS

The current version of these Terms is available on this page.

We may update these Terms by publishing a revised version and effective date. Changes apply prospectively unless applicable law requires otherwise.

Continued use of the website after an update constitutes acceptance of the revised Terms for future website use. A revised policy does not establish that a customer accepted that version for an earlier order.
